Those of you who have kept up with Joes lawsuit over being a foreclosure investor in Washington know what I am refering to. He fought for over a year against the government lawsuit. It had no basis in fact. Yet he lost, and lost big. Never even truly got his day in court. Truly sad.

This is truly sad. I have a friend who went down for the same reason a couple of years ago. He did nothing wrong, but he became the target and once you're the target, there is no winning.
Not only did it drain my friend financially, it did so mentally and emotionally. He's never completely recovered since then. The huniliation of what the media made him out to be (and they brought his family into it) is something that continues to haunt him today. The funny thing is that the primary witnesses for the state ended up being charged and convicted of fraud, forgery and purgory, but the media never reported that nor did they ever try to clear the name of my friend. In the end he was charged with nothing, and the state's witness went to jail and was ordered to make restitution. The representatives who were contacted by the "victim" are the ones who pushed through MD's foreclosure law as a result of this.
This is why I'm so skeptical about certain types of investing and what others are getting themselves into. I've been the guy in court who was right, but that didn't mean anything. I've lost twice when I was completely in the right. It's not about right and wrong anymore in this country- truth has been thrown out of the window and it's all about who can "create" the best story and if they can pull together the players to support their story- they stand a good chance of winning. This is happening to investors all across the country. The poor person who was losing everything can create a good story, and the attorneys will lie, I mean carefully create stories, to support their argument and pull on the heart strings of those making the rulings and paint of a good person to be a monster. They'll tear down the best of people to put a notch in their win column.
So when I come across as skeptical, it's only because I have seen it, and experienced it myself.
This is why I prefer to deal directly with banks who can't be the "victim" of little old me. In fact, I could probably hire one of these attorneys who is screwing investors and get them to represent me as a victim of the bank who sold me a bad bill of goods. I was supposed to make $50k and I only made $25k and I feel that the bank screwed me. These attorneys would take the case on and make the bank out to be such a bad guy for selling the property to me for too much (even though it was what I offered) and get me my settlement or pay day in court. We need torte reform in this country and the NONSENSE will stop! But then people would have to stop being victims- what fun would that be? Blessings,

Their tactic is simple... we have more money than you..
It's ridiculous....
I hope those guys are thrown out on their back sides when the time comes....
It has nothing to do with right or wrong....
Their is a TV show I like... called "shark" with James Woods... it recently got canceled....
But, it was about a criminal attorney that became a DA.... and although I loved the show.....
Stark... the head DA guy played by James Woods, who was formally nicknamed Shark... Used ever means possible to convict whoever he thought was the wrong doer... ethical, unethical, legal or illegal.... manipulating the system, jusdges full of bending the truths into whatever worked for him and his team to get the conviction.....
on who "their perception" should be the guilty party....
Of course in the show... they always ended up getting the bad guy.... but, many times they were after the wrong guys.... and that system of rushing to justice for political game was full corruption based on the needs of the DA's office , the Mayor and of course Stark himself...
To me it showed the underbelly of how those offices might work to a degree... maybe I'm just a conspiracy theorist...
But, if they want you... forget about it... they'll twist things to get it done right, wrong or indifferent....
As Steve said... The truth ain't got nothing to do with it...
Who's in office or what do they need to protect....
From what I could tell Joe had found a way to make literal millions in their system that wasnt their money.... but, to protect that money and make sure the state was going to get it in the end....
He needed to be out of business... and they needed broad sweeping unconstituional real estate laws to protect themselves.... from smart guys like Joe... that could do the same thing...

I deal alot with pre-foreclosure short sales. I'd been moving more towards REO's but this loss by Joe and his entire experience means I'll be moving permanently to REO's and VERY quickly.

He dealt in Tax preforeclosures.....
In other words... if a property was going up for sale at a tax auction... he's snap them up....
The problem being that the state would normally get those properties themselves and 3 years later get the benefit of any tax overages... which Joe was smart enough to capitalize on....
Since Joe effectively snapped up those monies by buying the property before auction... and then promoting the sell at the auction to any overages above the taxes went to the property owner....ie his company...
Those overages would normally go back to the state after 3 years passed.....
They didn't like him in their arena....
So, they tried to make him look a bad guy on his partnership deals with homeowners.... ie... never do buy/sale lease backs to the owner...
They went after him for one thing so they could effectively stop him from the other...
